Terms of Service

These Terms of Service (the "Terms") form a legally binding agreement between Recoll, operated from Spain (the "Provider", "we" or "us" — see also the Legal Notice), and you (the "User"), governing your use of the Recoll mobile application and related website (the "Service").
1. Definitions
- "Recoll" / "Service": the Recoll application and website, a voice-first personal memory journal that transcribes, structures and lets you search and query your memories using AI.
- "Content": the voice recordings you make, and the transcriptions and derived data (such as titles, summaries, people, places, topics and reminders) created from them in the Service.
- "Subscription": a paid plan giving access to premium features.
2. Eligibility
The Service is intended exclusively for adults. You must be 18 or older, or the age of majority in your country of residence if that is higher. By using Recoll, you represent that you meet that requirement and have capacity to enter into these Terms.
3. Acceptance
Using Recoll requires acceptance of these Terms and the Privacy Policy. If you do not agree, do not use the Service.
4. Description of the Service
Recoll lets you record a memory by voice; the Service transcribes it, extracts structured information (people, places, topics, dates), may suggest reminders for you to confirm, generates semantic representations, and lets you search and ask questions about your stored memories in natural language. The original audio recording is used to create the memory and is not kept once processing completes (see the Privacy Policy).
5. Account Registration
To use the main features you must create an account using an available sign-in method (Google, Apple, email/password or others we may enable). You are responsible for the accuracy of the data you provide, for keeping your credentials confidential, and for all activity under your account. Notify us of any unauthorised use at support@recoll.me.
6. Acceptable Use
You agree not to use Recoll to:
- store or distribute unlawful, defamatory or infringing content, or content that violates applicable law;
- include personal data about third parties without the necessary legal basis or consent (see Section 7);
- reverse engineer, decompile or attempt to extract the source code or underlying models, except as permitted by mandatory law;
- overload, damage or interfere with the Service or its security;
- use the Service in an automated manner or for purposes other than the intended personal use.
7. Your Content
Ownership. As between you and the Provider, you retain all right, title and interest you may have in the Content. These Terms transfer no ownership of the Content to the Provider, beyond the limited licence described below.
Licence. You grant us a limited, worldwide, non-exclusive licence to host, reproduce, process and adapt the Content for the sole purpose of operating the Service's features (transcription, structuring, generating semantic representations, search, reminders and answering your queries). This licence is not transferable or sub-licensable beyond our data processors, and it terminates when you delete the Content or your account, except for temporary technical copies or copies we must keep by law.
Responsibility. You are responsible for all Content you submit to the Service. You represent that you have the necessary rights and permissions over it — including a legitimate basis for including information about third parties — and that it does not violate the law or these Terms. We may refuse or remove Content that violates these Terms or the law.
8. AI Features and Disclaimers
Recoll uses one or more third-party AI providers for transcription, structuring and answering queries.
- AI results (transcriptions, summaries, answers, suggested reminders) may contain errors, inaccuracies or omissions.
- They do not constitute professional advice of any kind (medical, legal, financial or other) and must not be relied upon as the sole basis for important decisions.
- Reminders must not be used as the sole means for critical, health-related or deadline-bound obligations.
- The related data processing, including international transfers, is described in the Privacy Policy.
9. Subscriptions and Payments
Recoll offers a Free plan and paid subscriptions. Every plan includes AI transcription and structuring, semantic search and question answering; the plans differ in how many memories you can record and how many questions you can ask over a period. Recording length is capped for all plans. Paid plans raise those allowances.
Applicable limits. The applicable limits and prices are those shown in the app and on the App Store / Google Play listing at the time you subscribe, which prevail over any summary published elsewhere.
Fair use. Plans are sized for reasonable personal use. We may temporarily limit, with immediate effect, disproportionate, automated or abusive use that puts the stability or sustainability of the Service at risk, including within a period already paid for.
Adjustments to limits. We may adjust a plan's limits for valid reasons: increases in the cost of our AI or infrastructure providers, security, prevention of abuse or fraud, legal or regulatory requirements, or technical changes imposed by our providers. If an adjustment has more than a minor negative impact on you: (a) we will give you at least 30 days' prior notice by reasonable means; (b) it will preferably take effect from your next renewal; and (c) you may cancel at no cost before it takes effect — and if it exceptionally affected a period already paid for, you may terminate the contract and receive a pro-rata refund for the unused time.
Price changes. We may change plan prices. A price increase will not apply to a period already paid for: it will take effect, at the earliest, at your next renewal; we will notify you at least 30 days in advance (in addition to the store's own notices) and you may cancel before renewal to decline it. The relevant store may additionally require your express consent under its policies.
- Subscriptions are purchased and billed through the Apple App Store or Google Play, managed via RevenueCat. The applicable store's terms also apply.
- Unless stated otherwise, Subscriptions auto-renew for equivalent periods unless you cancel before renewal in the relevant store.
- Cancellation and refunds are governed by the policies of the store through which you purchased.
Right of withdrawal. As these are digital services with immediate performance, by starting to use them you may consent to immediate performance, which can entail loss of the statutory right of withdrawal under consumer law.
10. Intellectual Property and Trademarks
All rights in the Service, the "Recoll" name and logo, the software, design and our own content belong to the Provider or its licensors. These Terms grant you no rights to them beyond using the Service as permitted here.
11. Service Availability and Modifications
We do not guarantee uninterrupted availability of the Service. We may modify, suspend or discontinue features, in whole or in part, for technical, security or business reasons. Where a material change affects you, we will use reasonable efforts to give prior notice.
12. Account Termination
You may stop using Recoll and delete your account at any time from within the app or by contacting support@recoll.me. Deleting your account results in deletion of your Content as described in the Privacy Policy, except for data we must retain by law. We may suspend or terminate accounts that breach these Terms.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI OUTPUTS, OR UNINTERRUPTED OPERATION. Nothing in these Terms excludes warranties that cannot be excluded by law.
14. Limitation of Liability
To the extent permitted by law, the Provider shall not be liable for indirect, incidental or consequential damages, for loss of data due to causes beyond our control, or for your use of AI outputs. To the extent permitted by law, the Provider's total liability for any claims arising from the Service or these Terms is limited to the greater of: (a) the amounts you paid us in the 12 months preceding the event giving rise to the claim, or (b) €100. Nothing here excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, wilful misconduct or gross negligence, or mandatory consumer rights.
15. Governing Law and Disputes
These Terms are governed by Spanish law. If you are a consumer, you retain the mandatory rights of your EU country of residence. Disputes are subject to the courts of Spain, without prejudice to the consumer's forum.
If you are a consumer resident in the EU, you may also turn to an alternative dispute resolution body available in your country — in Spain, the consumer arbitration boards (Juntas Arbitrales de Consumo). The European Commission's online dispute resolution platform ceased operating on 20 July 2025 and is therefore no longer available.
16. Changes to These Terms
We may update these Terms. Changes are posted with their date and, where material, notified by reasonable means. Continued use after they take effect constitutes acceptance.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid one closest to the original intent.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Provider regarding the Service, superseding any prior agreement on the same subject.
